Software licence agreement

1. Agreement and software

By installing, activating or using NourForge software, you agree to this agreement. “Software” includes the application, updates, bundled assets and documentation supplied by NourForge. If you do not agree, do not install or use it.

2. Eligibility and authority

You must be legally able to enter this agreement. If you install or use the Software for an organisation, you confirm that you are authorised to accept these terms for that organisation, and “you” includes that organisation.

3. Free editions

NourForge grants you a non-exclusive, non-transferable licence to use a Free edition within its published product limits for personal, educational or internal business purposes. No purchase is required. Free limits affect published capacity or workspace features, not ownership of the underlying Software.

4. Full licences and included products

A valid purchase grants the named licensee a non-exclusive, non-transferable licence to use the Full product or products expressly included in that offer. An individual product licence does not unlock another product. The Archive Verify Bundle includes Creator and Checker. The NourForge Utilities Suite includes all three current Utilities applications. A Letter Mayhem Full licence unlocks the Full edition of Letter Mayhem only.

5. Device activation

Current NourForge Full licences (Utilities applications and Letter Mayhem) permit up to three concurrently activated devices for the licensed individual, subject to the purchased offer. Multiple application instances on one device do not consume another slot. A recognised reinstall may reuse an activation where device recognition is reliable. A new activation does not silently displace an existing device. Contact support for legitimate device-change problems.

6. Permitted copies and backups

You may keep reasonable backup copies of the installer and licence records for your own licensed use. You may not publish, distribute or make the installer or licence key available as a shared download unless NourForge has expressly authorised it.

7. Restrictions

You must not sell, sublicense, rent, lend, share or transfer a licence key; bypass or defeat technical limits; remove ownership notices; use the Software unlawfully; misrepresent it as your own; or reverse engineer, decompile or disassemble it except to the extent that applicable law does not permit that restriction.

8. Your files and responsibility

You retain ownership of files you process. The Software does not transfer ownership of archive or media content to NourForge. You are responsible for lawful access to those files, reviewing planned actions, maintaining appropriate backups and deciding how to act on results. Verification evidence and Match % are diagnostic information; they are not a repair service or a guarantee that a changed file is usable.

9. Third-party software

Third-party components remain subject to their own licences, identified in the notices supplied with the Software. MKV Batch Manager requires separately obtained MKVToolNix components, which remain governed by MKVToolNix’s terms.

10. Updates, compatibility and support

NourForge may provide fixes, security updates or feature changes. An update may change requirements or replace an earlier version. Support is provided through the published support channels and is not an unlimited maintenance or custom-development commitment unless separately agreed.

11. Licence suspension and termination

NourForge may suspend activation or terminate a licence where there is material breach, fraud, unauthorised key sharing or a reversed/refunded transaction, after considering the circumstances and any rights that cannot be excluded. Where a breach can reasonably be corrected, NourForge may give an opportunity to correct it. On termination, stop using and remove affected Full copies; lawful accrued consumer rights remain unaffected.

12. Consumer guarantees

Nothing in this agreement excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where liability can lawfully be limited, it is limited only to the extent permitted by law.

13. Disclaimers

Except for rights and guarantees that cannot be excluded, the Software is provided on an “as available” basis. NourForge does not promise that every file, third-party tool, storage device or operating environment is error-free or compatible. Published workflows, warnings and requirements must be followed.

14. Liability

To the maximum extent permitted by law, NourForge is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by unlawful use, ignored warnings, absence of reasonable backups, third-party software or hardware failure. This clause does not limit liability where doing so would be unlawful.

15. Changes to this agreement

The version accepted for a purchase or installation continues to govern that transaction unless a lawful update is accepted. NourForge will not silently remove accrued rights. Material changes will be identified by the effective date.

16. Severability and no waiver

If a term is unenforceable, it is read down or severed only to the extent needed, and the remaining terms continue. A delay in enforcing a term is not a waiver.

17. Governing law and disputes

This agreement is governed by the laws of Victoria, Australia, subject to any mandatory law that applies where you live. Contact support first so a dispute can be investigated in good faith. This does not prevent either party using a regulator, tribunal or court where entitled.

18. Games, saved data and online play

NourForge games (currently Letter Mayhem) store settings and local score tables beside the game. A Letter Mayhem Full licence unlocks the Full edition of Letter Mayhem only; no Utilities licence, bundle or suite includes it, and it includes none of them. Online leaderboards are an optional connected service that may be switched on per platform, may be unavailable, and may be changed or withdrawn; submissions are validated and may be delayed, rejected, removed or reset to protect the integrity of the boards. Automation, tampering with the game or its submissions, impersonation and offensive names are not permitted. Editions obtained through a store (for example Steam) are also governed by that store's terms. The games contain no real-money element.
